By accessing or using PacePics ("the Service"), you agree to be bound by these Terms of Service. PacePics is a two-sided marketplace where photographers sell race photos and athletes purchase them. If you do not agree to these terms, you may not use the Service.
2Platform Model
PacePics is a race photo platform connecting organizers, photographers, and athletes:
Organizers
Create events and share magic upload links with photographers
Photographers
Upload race photos via magic link — no account required
Athletes
Find and download their race photos for free by bib number
PacePics provides photo hosting and AI-powered bib detection to connect the endurance community around race photography.
3User Accounts
Account Creation
You must create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Eligibility
You must be at least 13 years old to use the Service. Users under 18 should have parental consent.
Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
4User Roles
Athletes
- Search for photos by bib number
- Purchase and download race photos
- Create a profile to organize photos
- Follow friends and view galleries
Photographers
- Upload and manage race photos
- Upload photos via magic link (no account needed)
- Photos are AI-tagged for bib search
- Retain full copyright of all photos
8Content Ownership & Rights
🔒 Photographer Content
Photographers retain full copyright ownership of all photos they upload. By uploading photos, photographers grant PacePics a worldwide, non-exclusive, royalty-free license to:
- Host, display, and distribute photos on the platform
- Create thumbnails and watermarked preview images
- Process photos for bib number detection
- Use photos in marketing materials with photographer attribution
Photographer Representations
By uploading photos, photographers warrant that:
- They own or have rights to all photos they upload
- Photos do not infringe on third-party rights
- They have necessary permissions to photograph at the event
- Content complies with applicable laws and these Terms
Downloaded Photos
When you download a photo, you receive a personal, non-commercial license to use the photo for personal purposes. You may share on social media with photographer credit. Commercial use requires separate licensing arranged directly with the photographer.
9Prohibited Conduct
To maintain a safe and fair marketplace, you agree not to:
10Privacy & Data
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information, including the use of OpenAI for bib number detection.
11Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or at our sole discretion. You may delete your account at any time through your account settings.
12Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for content uploaded by users or for any transactions between photographers and athletes beyond facilitating the marketplace.
13Limitation of Liability
To the maximum extent permitted by law, PacePics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, data loss, or damages arising from transactions with other users.
14Changes to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
